Terms of Service

Welcome to Haraka. These Terms of Service ("Terms") govern your access to and use of app.haraka.delivery and our related mobile and delivery services (the "Service"). By creating an account or placing an order you agree to these Terms.

1. The Service

Haraka is a marketplace that connects customers with independent vendors and couriers for the ordering and delivery of groceries, food and everyday essentials in Zanzibar. Haraka facilitates transactions but does not manufacture or prepare the goods sold on the platform.

2. Eligibility & accounts

• You must be at least 18 years old to use Haraka.
• You are responsible for the accuracy of the information on your account and for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account.

3. Orders and payments

• Prices, availability and delivery fees are shown at checkout and may change.
• Payments are processed by our payment partner (Snippe / M-Pesa). By placing an order you authorise the charge for the order total, including delivery fees and applicable taxes.
• Once an order is accepted by the vendor, it may not be cancellable. Refunds are handled on a case-by-case basis in line with our support policy.

4. Delivery

Estimated delivery times are indicative and may vary depending on traffic, weather, vendor preparation time and courier availability. Please ensure the delivery address, phone number and PIN provided at handover are accurate.

5. Vendors and couriers

Vendors are responsible for the quality, description and safety of the goods they sell. Couriers are responsible for professional and timely delivery. Both vendors and couriers operate as independent partners on the Haraka platform.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to order restricted or prohibited items.
• Attempt to interfere with, disrupt or gain unauthorised access to the Service.
• Impersonate any person or misrepresent your affiliation with any entity.
• Harass, threaten or abuse other users, vendors or couriers.

7. Ratings and content

You retain ownership of the content you submit (such as ratings and reviews), but grant Haraka a worldwide, royalty-free licence to use, display and distribute that content on the Service. Content must be truthful and must not violate the rights of others.

8. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, engage in fraudulent activity or otherwise pose a risk to Haraka or its users.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, Haraka disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, Haraka's total liability for any claim arising out of or related to the Service is limited to the amount you paid for the order giving rise to the claim. Haraka is not liable for indirect, incidental, special or consequential damages.

11. Governing law

These Terms are governed by the laws of the United Republic of Tanzania. Any dispute arising from these Terms or the Service shall be resolved in the competent courts of Zanzibar.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
